Annulment

Annulment

Certain marriages are what the law terms as "voidable". In those specific cases, the court may find grounds for an Annulment. The court will enter a Nullity Judgment. While a Dissolution of Marriage dissolves the existing marriage, a Nullity Judgment erases the marriage and its implications from the onset, as though the parties had never married. There are no issues of Spousal Support or Community Property for the court to decide because the result of the decree is that there is no marriage. A Judgment of Nullity, or Annulment, may only be obtained under specific circumstances including cases of incest, bigamy and fraud. The law provides specific findings which your lawyer will help you determine whether they apply.

In order for you to make decisions regarding divorce, legal separation, or annulment, you must be well informed and have competent professional advise.
